A Bad Tattoo? Can I Sue?

I was asked this week about the statute of limitation … on a tattoo.

This was the question: can I sue over a bad tattoo? Here is the answer most every lawyer will give you, “Maybe.”

There is one thing I will definitely tell you.  If you are saying the tattoo caused you harm, you only have 2 years to file a lawsuit in Alabama. That is the law in our state on most any injury case. This could cover unsanitary conditions, damage to your health or even an infection that caused major medical problems.

This doesn’t mean, that if you just don’t like it, you can get your money back. Most tattoo artists will have you sign a release that covers foreseeable problems. The release will have you acknowledge possible health risks, variations in artistic interpretation and the potential for something going wrong like crooked lines.

If your buddies can’t stop laughing at the unicorn running through puffy clouds on your chest … keep your shirt on. You probably won’t win in court.

Here is my strong legal advice … if you are going to get a tattoo, go to a reputable establishment. I would also strongly recommend that pigment and beer pong do not mix. So, no drinking and tattooing.

Now it doesn’t hurt to complain if you are unsatisfied, but to go through the process of a lawsuit, the damage needs to be something serious … not just misspelling your girlfriend’s name. However, they should offer to fix that anyway.
