Clients often ask me why I gather all those medical records about their past medical condition. That is their condition BEFORE the accident. It is to stop one of the insurance companies’ biggest tricks.

Let’s say your leg is causing you a lot of pain after a traffic accident. The insurance company might try to show it was a pre-existing condition and that you are lying about it.

The trick is to have you say you did NOT have a problem with your leg before the accident and they can prove, through the medical records, you did.  This puts your whole testimony into doubt.  If it gets before a jury, there is a good chance that at least one juror will be skeptical and you could lose the entire case.

It is a slimy trick because often people forget about relatively minor injuries.

Let’s say you sprained an ankle years ago. You got medical treatment and it got better.  You could easily forget all about it. You didn’t attempt to lie or deceive anyone but it could appear differently.
