There are two main ways to get you money after a boating accident, but they both center around suing. First, you can negotiate with an insurance company, because the insurance folk want to prevent a lawsuit, or file a lawsuit and let a judge or jury decide.

To collect, your injuries must be directly linked to the boating accident. This is critical. If you are injured because you tripped on the way to the boat, you may get your boat repaired but not your medical expenses paid.

Here is how you can help yourself.

  • Get Medical treatment. This is critical. If you are not injured, there is no case. Just because someone did something wrong, doesn’t mean they owe you money.
  • Collect evidence
  • Get names and info from eyewitnesses
  • File an accident report
  • Take photographs

Among the things I must prove is that the person you are suing actually caused the situation that injured you. This is not as easy as it might appear. You know a boat hit your jet ski, but who was at the wheel of the boat, who owns the boat and were proper procedures followed in operating the boat? Sorting all that out often requires an investigator and talking to a lot of people.

Here is an example of something that can change the case:  Was the skipper an employee, owner, renter or guest? The law can treat them differently.
